Ofcom Announces the End of G22 Rules

Ofcom has announced that its much-used General Condition 22, which came into being in 2007, may no longer be in use. The GC 22 was a boon to broadband users who found the rule extremely useful during migration from one service to another to prevent any mix-ups by providers.

The provision is used by Ofcom to arbitrate any disputes that arise when a user gives a MAC code to shift from one provider to another. Quoting falling complaint figures as the reason for disbanding the provision, Ofcom pointed out that in 2007 there were 825 complaints in this regard. The number of complaints has now come down to 147, showing that the area no longer needs such a close watch or stringent guidelines.

Further, enforcement and study by Ofcom representatives have shown that most providers are complying with the regulations without any need for caution or warnings from Ofcom. As most consumers are able to change providers without any issues, there is no longer a specific need for such regulations, the telecom watchdog said.

Earlier, service provider Pipex was one of the most carefully scrutinised ISPs owing to a number of complaints received against them with respect to MAC codes. Pipex was also issued a warning in 2008 for violation of rules. Following this, the provider seems to have taken necessary steps to ensure compliance, as the number of complaints against it has reduced drastically.

Isle of Man to Trial Internet Tax in Fight against Music Piracy

More details have come forward on the Isle of Man plan to levy a compulsory music download tax on the residents.

According to the proposed plan, everyone connected to the Internet would be charged about £1 extra per month. The idea is that the artists would be compensated for the loss they suffer due to illegitimate music downloads. The payments would be made according to the overall music downloads either directly from a website or through file sharing via a P2P network. This would require monitoring by the ISPs for which all ISPs servicing the Isle of Man would be required to install hardware which is capable of doing that. As a compensation for the extra expense and effort, the ISPs would also receive a share from the tax collections.

The proposal seems to raise more questions than it answers. The biggest hurdle that the proposal could face is that monitoring a user’s internet activity would lead to invasion of privacy, and the residents are bound to raise their voice against that. The proposal also does not clearly state whether other types of content such as movies and games would also be affected by it.

Moreover, the proposal is likely to raise a few eyebrows as it aims to apply the tax to anyone with access to an internet service (not just broadband). A user will be charged even if there is no existing hardware to play the music on, a condition which will irk the businesses more than anyone else.
